These Terms of Service (the “Terms”) apply to your use of the Elite Psychology website and its online inquiry, intake, scheduling, payment, communication, and referral tools. By using the website or completing an online transaction, you agree to these Terms.
These Terms do not replace an informed-consent document, assessment-service agreement, payment agreement, organizational agreement, or other written agreement that applies to psychological services. If a separate agreement conflicts with these Terms, the separate agreement controls for the services it covers, except that no commercial term overrides applicable law or a regulated professional's ethical, clinical, privacy, record-keeping, public-protection, or other professional obligations.

Psychology is a regulated profession in Manitoba. Psychological services are provided under the professional responsibility of practitioners registered or otherwise legally authorized to practise within the scope of their registration, competence, supervision arrangements, and professional authority. The business corporation does not replace or limit an individual registrant's professional duties.
The Psychological Association of Manitoba (PAM) is the provincial regulatory body for psychology. A practitioner's registration category and status may be verified through PAM's public register at cpmb.ca. Only practitioners authorized for independent practice may practise independently. Candidates, associates requiring supervision, students, technicians, psychometrists, or other team members may participate only within their lawful roles and supervision arrangements.
2. General information—not psychological or emergency advice
Website content is provided for general information. It is not psychological advice, diagnosis, treatment, a professional opinion, or emergency support, and it should not be relied upon as a substitute for individualized professional care.
Submitting a form, requesting a booking link, booking a consultation, or selecting an assessment appointment does not by itself create a psychologist-client relationship or guarantee that Elite Psychology will accept a referral. A service relationship begins only after Elite Psychology confirms the arrangement and any required screening, consent, authorization, eligibility, payment, or organizational requirements are completed.
Elite Psychology does not provide emergency or crisis services through this website, email, text, WhatsApp, online forms, or chat. If you or another person may be in immediate danger, contact 911 or an appropriate emergency or crisis service.
3. Services, eligibility, and geographic limits
Elite Psychology provides psychological assessments and related intake, consultation, testing, feedback, reporting, recommendation, and administrative services. Available services, methods, locations, timelines, and eligibility requirements may vary.
Some services may be delivered virtually, in Winnipeg, or through expressly arranged travel-to-you services. Services are ordinarily limited to people and organizations located in jurisdictions where the involved professionals are permitted to provide them. Elite Psychology may decline, postpone, modify, or refer a request when a service is not clinically appropriate, required information or authority is missing, professional or jurisdictional requirements cannot be met, safety concerns arise, or the requested service falls outside available competence or capacity.
4. Minors, guardians, and organizational referrals
If you provide information or make arrangements for another person, you represent that you have the legal authority to do so and that the information you provide is accurate to the best of your knowledge.
Parents and guardians must disclose any custody arrangement, court order, decision-making restriction, or other circumstance that may affect consent, access to records, payment, or disclosure of information. Elite Psychology may request documentation before proceeding. Capacity and authority to consent are determined under applicable law and professional standards, and a capable young person may have consent rights that are not determined solely by age. Where another person provides legal consent, Elite Psychology will also seek the client's assent where appropriate and practicable.
An organization arranging services for another person is responsible for having appropriate authority to make the referral and share information. The organization must not assume that it will receive clinical information or a report unless the client, guardian, law, or applicable agreement authorizes disclosure.
5. Booking and formation of an online agreement
Before you complete an online purchase or booking, the applicable booking page, checkout, confirmation, or service agreement will identify the service selected, price, currency, payment method, appointment or service-start information, and any material restrictions or additional charges that apply.
An online agreement is formed only when the booking or purchase is successfully completed and confirmed. An automated acknowledgement does not require Elite Psychology to proceed if there is an obvious pricing or technical error, a payment is not completed, required authority or consent is missing, the selected service is unsuitable, or providing the service would conflict with legal or professional obligations. If Elite Psychology cannot honour a paid booking, it will contact the purchaser and address any amount paid in accordance with the applicable agreement and law.
Appointment and service timelines are estimates unless a written agreement expressly guarantees a date. Report timelines begin only after all required testing, interviews, records, questionnaires, collateral information, and payments have been received.
6. Prices, payment, funding, and financing
Unless stated otherwise, prices are in Canadian dollars. The current service price and any applicable taxes, travel charges, deposits, financing costs, or other charges will be disclosed before purchase or in the applicable written agreement.
Payment may be required in full, by deposit, by an agreed payment schedule, or through an approved organizational or third-party funding arrangement. A booking is not treated as fully paid merely because a funding, insurance, financing, or reimbursement application has been submitted.
Insurance coverage, government or community funding, Disability Tax Credit eligibility, school accommodations, workplace accommodations, and other third-party benefits or approvals are determined by the relevant third party. Elite Psychology does not guarantee approval, coverage, reimbursement, or any particular financial or administrative outcome. Unless a written agreement states otherwise, the person or organization purchasing the service remains responsible for charges not paid by a third party.
Third-party financing or payment-plan options, including any option offered through Affirm, Klarna, PayPal, a card issuer, or another provider, are subject to that provider’s eligibility requirements and separate terms. Elite Psychology is not the lender and does not control financing approval, interest rates, fees, or the provider’s decisions.
7. Cancellations, rescheduling, missed appointments, and refunds
The cancellation, rescheduling, missed-appointment, deposit, and refund terms shown during booking or contained in the applicable confirmation, informed-consent document, service agreement, payment agreement, or organizational agreement form part of the agreement for that service.
Different terms may apply depending on the service, whether professional time has already been reserved or used, whether testing materials or records have been reviewed, whether a report has been started, and whether third-party or non-recoverable charges have been incurred. A fee will be charged only where it has been disclosed or is otherwise permitted by the applicable agreement and law.

Nothing in these Terms limits a cancellation, refund, charge-reversal, or other right that cannot lawfully be waived, including any applicable right under Manitoba consumer-protection legislation.
8. Assessment process and professional judgment
Psychological assessment is an individualized professional process. Elite Psychology cannot guarantee a diagnosis, a particular test result, a particular recommendation, acceptance of a report by a third party, or eligibility for medication, benefits, funding, tax credits, accommodations, programming, or services.
Conclusions and recommendations depend on the information reasonably available at the time. Incomplete, inaccurate, withheld, or late information may affect the scope, timing, validity, or interpretation of an assessment. Elite Psychology may require additional information, testing, consultation, or an in-person component when professionally necessary.
The client or authorized decision-maker will receive separate information about the specific assessment, its purpose and limits, foreseeable benefits and risks, reasonable alternatives, consent, limits of confidentiality, records, fees, intended recipients of information, and the roles of the professionals involved. Informed consent is an ongoing process and may be revisited if the service, circumstances, participants, technology, use of information, or professional roles change. Consent may be withdrawn subject to work already performed, legal and professional duties, safety requirements, and the practical consequences explained in the applicable consent or service agreement.
If a candidate, supervisee, student, technician, psychometrist, or another non-independent team member participates in the service, the client or authorized decision-maker will be informed of that person's role, the responsible supervisor where applicable, and the material terms of the arrangement before that person's psychological services begin.
9. Your responsibilities
You agree to:
- provide accurate, complete, and current information;
- promptly correct information that becomes inaccurate;
- provide documents, questionnaires, consents, and collateral information reasonably required for the service;
- attend scheduled appointments or provide notice in accordance with the applicable cancellation policy;
- maintain a reasonably private, safe, and technically suitable environment for virtual services;
- avoid recording a session unless everyone involved has expressly agreed; and
- use reports, booking links, forms, and portal access only for their intended and authorized purposes.
You must not misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, impersonate another person, submit knowingly false or misleading information, or use website content or services in violation of law or the rights of others.
10. Virtual services and electronic systems
Virtual services and electronic systems can involve internet interruptions, device or software failures, limits on observation, privacy risks in the participant’s environment, and risks associated with electronic transmission or storage. No electronic system can be guaranteed to be completely secure or continuously available.
Elite Psychology may pause, reschedule, modify, or require an in-person component when technology, privacy, safety, identity verification, location, assessment validity, or professional judgment makes that appropriate.
For a virtual appointment, participants may be asked to confirm their identity, physical location, privacy, and an appropriate local emergency contact or response plan. A client must promptly advise Elite Psychology if they will be located outside Manitoba, because professional authorization and service availability can depend on the client's location at the time of service.
11. Artificial intelligence and technology-assisted tools
Elite Psychology may use artificial-intelligence-assisted and other technology-assisted tools to support administrative work, scheduling, documentation, transcription or review of recorded information where separately authorized, information organization, scoring workflows, draft preparation, quality assurance, and other appropriate practice functions.
AI tools do not independently establish a psychologist-client relationship and are not the final decision-maker for a diagnosis, clinical interpretation, recommendation, or psychological report. Human professional judgment remains primary. The responsible psychological professional remains accountable for the service and must independently review and approve clinical conclusions and final reports.
AI-generated or technology-assisted output may be incomplete, inaccurate, biased, or unsuitable for a particular purpose. Elite Psychology will use such output only within the responsible professional's competence and will apply appropriate review, safeguards, and professional judgment.
Any personal or personal health information processed through these tools is handled under the Privacy Policy, applicable consent documentation, contractual safeguards, and legal and professional requirements. Material use of AI, recording, or technology in a clinical service will be disclosed and consent obtained where required. Protected psychological test content, raw data, scoring keys, and similar materials will not be placed into systems that are not appropriately authorized for that use.
Clients and authorized decision-makers may ask questions about material AI use and available alternatives. Any concern or withdrawal of consent will be addressed through the applicable informed-consent and service process, subject to work already completed and legal or professional obligations.
12. Electronic communications
Elite Psychology may send service-related communications needed to respond to an inquiry or administer a requested service, including booking confirmations, reminders, intake requests, payment notices, rescheduling information, cancellation information, and follow-up relating to an assessment.
Optional marketing or promotional email and text messages require the consent or other lawful basis applicable to those messages. Marketing consent is not a condition of receiving psychological services. You may withdraw marketing consent using the unsubscribe mechanism provided, by replying STOP where supported, or by contacting Elite Psychology. Withdrawing marketing consent does not prevent necessary service, safety, billing, or legally required communications.
Ordinary email, text messaging, WhatsApp, and similar communications may not be fully secure. Contact Elite Psychology if you would like to discuss available communication alternatives.
13. Privacy and personal health information
Information submitted through the website and information collected in providing services is handled in accordance with the Elite Psychology Privacy Policy, applicable consent and service documentation, and applicable privacy, health-information, legal, and professional requirements.
The Privacy Policy explains the types of information Elite Psychology collects, how information may be used or disclosed, electronic systems and service providers, storage outside Canada, records, access and correction rights, safeguards, and privacy concerns or complaints.
14. Third-party services and links
Elite Psychology may use or link to third-party services for scheduling, forms, payment processing, financing, messaging, videoconferencing, analytics, maps, reviews, document exchange, or other operational purposes. These may include services provided by GoHighLevel/LeadConnector, Calendly, Stripe, PayPal, Affirm, Klarna, Google, Microsoft, WhatsApp/Meta, Tally, or successor or alternative providers.
Third-party services are governed by their own terms and privacy practices. Elite Psychology does not control their availability, eligibility decisions, financing terms, or independent acts. A link does not constitute an endorsement of all third-party content or practices.
15. Reports, test materials, and intellectual property
Unless stated otherwise, website text, branding, graphics, and original materials belong to Elite Psychology or its licensors and may not be copied, republished, modified, sold, or used commercially without permission.
Psychological reports provided to a client or authorized recipient may be used for the purposes for which they were prepared, subject to confidentiality, consent, copyright, and any restrictions explained with the report. Access to records and disclosure of assessment information are governed by applicable law, professional standards, consent, and the rights and welfare of the client; payment status does not eliminate any non-waivable record-access or continuity-of-care obligation. Psychological tests, test questions, protocols, scoring materials, raw data, scoring keys, and other protected test content may be restricted from copying, disclosure, or distribution to preserve test security and comply with professional obligations and third-party rights.
16. Website availability, accuracy, and changes
Elite Psychology aims to keep website information accurate and current, but services, availability, pricing, team members, processes, technologies, and content may change. Online tools may be interrupted, delayed, or unavailable.
Elite Psychology may correct errors and update the website, these Terms, or available services. A material change will apply prospectively unless law or a separate agreement permits otherwise. The version posted when an online agreement is completed forms part of that agreement together with the service-specific information presented at booking.
17. Accessibility and accommodation
Elite Psychology aims to provide information and services in a manner that respects dignity, independence, integration, and equal opportunity for people disabled by barriers. Clients, prospective clients, support persons, and other members of the public may request a communication support, accessible format, service accommodation, or information about an accessibility feature, and may provide feedback about accessibility, by using the contact information below.
Elite Psychology will address requests individually and make reasonable efforts to identify, prevent, and remove barriers in accordance with applicable accessibility and human-rights requirements. An accommodation may be adapted where necessary to protect privacy, safety, psychological test security, standardized administration, assessment validity, or another legal or professional obligation. Where the originally requested measure cannot reasonably be used, Elite Psychology will discuss an appropriate alternative where one is available.
18. Disclaimers and limitation of liability
To the extent permitted by law, Elite Psychology is not responsible for indirect, incidental, special, or consequential loss arising solely from use of, or inability to use, the public website or an independent third-party service.
Nothing in these Terms excludes or limits liability, professional responsibility, consumer rights, privacy rights, complaint rights, or other obligations that cannot lawfully be excluded or limited. Psychological services remain subject to applicable law, professional standards, informed consent, and the specific service agreement.
19. Suspension or termination of website access
Elite Psychology may restrict website or online-tool access where reasonably necessary to protect security, privacy, clients, staff, systems, legal compliance, or the rights of others. Restricting website access does not alter record-retention duties, payment obligations already incurred, or rights arising under an existing service agreement.
Ending website access is not the same as terminating an established professional relationship. If psychological services must end before completion, the responsible professional will address termination, notice, client welfare, records, and information about reasonable alternatives or referral assistance as required by the circumstances, applicable law, professional standards, and the service agreement.
20. Governing law and complaints
These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable in Manitoba. Subject to any non-waivable right or required process, disputes concerning these Terms may be brought before the courts or tribunals having jurisdiction in Manitoba.
Nothing in these Terms prevents a person from raising a privacy, consumer-protection, professional-regulatory, funding, insurer, or other complaint with the appropriate body. Concerns may first be directed to Elite Psychology using the contact information below, but doing so is not a prerequisite to contacting a regulator or exercising another legal right.
Questions about a psychology practitioner's registration or concerns about professional conduct may be directed to the Psychological Association of Manitoba, the provincial regulator, through its complaints and appeal information or by contacting the regulator at the current coordinates published on its website. Elite Psychology will not require a client to waive a regulatory complaint right as a condition of receiving services.
21. Severability and entire agreement
If a provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
These Terms, the service-specific information presented during booking, the Privacy Policy, and any applicable informed-consent, payment, service, or organizational agreement form the agreement for the relevant online transaction or service. A separate signed agreement prevails where it expressly conflicts with these Terms.
